DISTANCE SALES AGREEMENT

ARTICLE 1 – PARTIES

This Distance Sales Agreement (“Agreement”) is concluded electronically between the Seller and the Buyer who places an order via www.postostudio.com.

Buyer Information

The Buyer is the person whose information is provided during the order process.

ARTICLE 2 – SUBJECT OF THE AGREEMENT

This Agreement regulates the rights and obligations of the parties in accordance with Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts regarding the sale and delivery of products ordered by the Buyer via www.postostudio.com.

The Buyer declares that they have reviewed and electronically approved all pre-contractual information including the essential characteristics of the product, sale price, payment method, delivery terms, and right of withdrawal.

ARTICLE 3 – PRODUCT AND PAYMENT INFORMATION

Product details, quantity, unit price, and total amount are specified on the order confirmation page.

Payment shall be made using the methods offered on the website.

The Buyer is responsible for providing accurate and up-to-date payment information.

ARTICLE 4 – DELIVERY TERMS

4.1. The product shall be delivered to the address specified by the Buyer during the order process.
4.2. Orders are dispatched within 10 business days, unless otherwise stated.
4.3. The maximum legal delivery period is 30 days.
4.4. Delivery timelines for custom-made items may vary and will be communicated prior to production.
4.5. Upon delivery, the Buyer must inspect the product. In case of damage, a damage report must be issued with the carrier.

ARTICLE 5 – RIGHT OF WITHDRAWAL

5.1. The Buyer may exercise the right of withdrawal within 14 days from the date of delivery without providing any reason.
5.2. Withdrawal must be notified in writing (email is sufficient).
5.3. Returned products must be unused, undamaged, and in original packaging with all accessories included.
5.4. Products used for photoshoots, events, commercial purposes, or any other usage are not eligible for withdrawal.
5.5. All returned items are inspected upon arrival. If signs of use, deformation, stains, odor, fabric stretching, assembly marks, or any condition preventing resale are detected, the return will be rejected.
5.6. Approved refunds are processed within 3–7 business days via the original payment method.

ARTICLE 6 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to:

  • Custom-sized products

  • Made-to-order furniture

  • Personalized products (fabric, color, dimension selection)

  • Custom-designed products created upon the Buyer’s request

Such products are produced exclusively for the Buyer and are non-returnable and non-exchangeable.

ARTICLE 7 – DEFECTIVE GOODS AND WARRANTY

7.1. The Seller warrants that the product complies with contractual specifications at the time of delivery.
7.2. Manufacturing defects are covered by a 24-month warranty period.
7.3. Damage caused by improper use is not covered under warranty.
7.4. In the case of defective goods, the Buyer may request repair, replacement, price reduction, or refund in accordance with applicable law.

ARTICLE 8 – PROTECTION OF PERSONAL DATA

Personal data provided by the Buyer shall be processed for order fulfillment and legal compliance purposes and protected in accordance with Turkish Personal Data Protection Law (KVKK No. 6698).

ARTICLE 9 – FORCE MAJEURE

The Seller shall not be liable for delays caused by force majeure events such as natural disasters, transportation disruptions, strikes, or customs delays. The Buyer shall be informed in such cases.

ARTICLE 10 – DISPUTE RESOLUTION

In case of disputes, Consumer Arbitration Committees and Consumer Courts at the Buyer’s place of residence shall have jurisdiction in accordance with applicable law.

ARTICLE 11 – EFFECTIVENESS

This Agreement becomes effective upon the Buyer’s electronic confirmation during the order process.
